MoCRA what is it good for?

You! That’s who!

Happy New Year!

It’s not often that I can report some exciting, positive news out of our nation’s capitol that we can all agree on…but I have to tell you some great news if you didn’t hear or see it already on social media! As so many of us were preparing for the holidays, congress passed the first-ever significant reform that governs the personal care industry. The Modernization of Cosmetic Reform Act of 2022 (MoCRA) passed congress as part of the government spending bill allowing the FDA to collect fees to expand its power to regulate some products, including cosmetics.

You may or may not realize that a federal law has not been passed governing the industry since 1932. Why should you care? If you were like me, I assumed that because a product made it to store shelves, it had to be safe, right? In actuality, before now, the FDA had little authority to regulate the safety of any product. It wasn’t until I was introduced the work Beautycounter was doing that I learned about the need for more regulation in the industry. My health history of infertility and the company’s mission to educate consumers and advocate for legislative change propelled me to partner with the company as a brand advocate.

Together (including many of you), as a collective community effort sent 236,000 emails, made over 16,000 calls, and held over 2,200 meetings with Members of Congress. I am really excited about what our advocacy efforts this year, Beautycounter’s 10th Anniversary, will bring. Starting next month, we will have advocacy power hours to learn more about what we are doing to ensure that all people have access to safe products.

So here’s what MoCRA covers:

  1. New Requirements for Cosmetics

    • Adverse Event Recordkeeping and Serious Adverse Event Reporting (Section 605)

    • Mandatory Facility Registration, Product and Ingredient Listing (Section 607)

    • Cosmetic Safety Substantiation (Section 608)

    • Cosmetic Labeling and Fragrance Allergen Transparency (Section 609)

  2. New FDA Enforcement Authorities

    • Facility Suspension (Section 607)

    • Records Access (Section 610)

    • Recall Authority (Section 611)

  3. Other Notable Provisions

    • Preemption (Section 614) of State or Local Laws

    • OTC Drug-Cosmetic Clarity (Section 613)

    • Animal Testing

    • Small Business Accommodations (Goat Soap Sales People, we are looking at you!…IYKYK)

    • Resources for FDA

Jen Lee, Chief Impact Officer at Beautycounter, believes MoCRA marks a meaningful step in the right direction, "Consumers are demanding safety and transparency, and it is because of this community that we can celebrate this progress. Beautycounter was founded because we believed we could raise the standard for the beauty industry. There is still work to do, but we are one step closer toward achieving our mission of getting safer products into the hands of everyone."

Cheers to your healthy attitude in 2023!

xo, Allyson
